
Government and Public Sector undertakings employees beware. Don’t show any lapse in discharge of your duties otherwise you have to pay dearly besides other heavy consequences.
In a recent judgement titled ‘State of M.P. vs Ramkumar Choudhary’ the Supreme court of India while dismissing the Special Leave Petition, it deplored the callous and lackadaisical attitude of government official in discharging their duties. Since delay in filing SLP was 1788 days due to lapses of the official functioning under the State of M.P. despite involvement of valuable land, the Supreme Court directed all the state governments to fix the responsibility on the officers concerned and penalize them, who is/are responsible for the delay, deviation, lapses etc. if any to the value of the loss caused to the government. All the states have to follow these directions scrupulously.
In other words getting the delay condoned after expiry of statutory period of limitation shall be extremely difficult and in view of the aforesaid directions the responsibility of officers responsible for delay and lapses would be fixed in every case.
